Hartline Barger Obtains Dismissal in Wrongful Death Claim

Harris County, TX, February 06, 2023 — In February of 2023, Brian Rawson, Roy McKay, and Kristina Everhart successfully had all claims dismissed against a restaurant client.  The Harris County wrongful death lawsuit arose from a multi-vehicle accident in which a passenger of a vehicle passed away.  The decedent’s family alleged that the restaurant was liable under the Texas Dram Shop Act for overserving a third-party driver when he was obviously intoxicated and a clear danger to himself and others which resulted in the accident.  After conducting written discovery, there was no evidence that the driver was served at the restaurant and the plaintiffs dismissed their claims.
