Hartline Barger Secures Dismissal in Premises Liability Claim

Harris County, TX, November 23, 2022 — In November 2022, Brian Rawson, Tyler Stuart, and Kristina Everhart successfully had all claims dismissed against one of their restaurant clients after filing a summary judgment motion.  The Harris County premises liability lawsuit arose from a slip and fall incident in which the plaintiff alleged that the restaurant failed to warn or make safe liquid on the floor.  The plaintiff claimed as a result of the accident, she suffered from soft tissue hand, knee, and spinal injuries.  The restaurant filed a summary judgment motion asserting there was no evidence that the restaurant knew or should have known of the liquid on the floor.  Rather than respond to the summary judgment motion, the plaintiff dismissed her claims.
