
Kelly McKee Scores Victory for Contractor in Personal Injury Case
In a recent victory, Kelly McKee successfully represented our client in a case before the 224th District Court of Bexar County, Texas, where a plaintiff alleged an eye injury caused by dust and debris that purportedly fell into his eye during an incident at a San Antonio warehouse undergoing roof replacement. The plaintiff asserted that our client, a contractor who was not on-site at the time of the incident, was negligent in causing the injury.
Despite the absence of our client from the scene, the plaintiff argued that negligence on the contractor's part had led to the unsafe conditions that allegedly resulted in the injury. In response, Kelly McKee led the defense, filing a motion for no-evidence summary judgment, which asserted that the plaintiff had failed to provide any concrete evidence connecting our client’s actions to the injury.
A hearing was held before Honorable Marisa Flores of the 224th District Court, and after a thorough review of the discovery process and the lack of supporting evidence, the Court agreed with McKee’s argument. Judge Flores ruled that no evidence had been presented to establish any negligence on the part of our client. As a result, the plaintiff's claims were dismissed with prejudice, effectively concluding the case in our favor.
