Matt Gelina & Team Secure MSJ in Tire Blowout Case
Congratulations to Partner Matthew Gelina, Senior Counsel Jeffrey Bell II, and Associate Joshua Logsdon who recently won a No-Evidence Motion for Summary Judgment in Harris County. The motion disposed of all claims raised against the defendants by both plaintiffs.
The case involved a client’s truck hitting a pothole on I-10 and subsequently experiencing a tire blowout and then hitting Plaintiffs’ vehicle. The plaintiffs had evidence of significant medical bills and future recommendations for major medical procedures. The exposure to the defendants was significant.
The Hartline Barger team pursued an MSJ based on duty and proximate cause and relied on a recent Supreme Court case dealing with a tire blowout specifically. Plaintiffs’ counsel fought hard in both written pleadings and during the oral hearing. After taking the matter under advisement, the Court returned a decision in favor of the defense and all claims raised were dismissed.

Hartline Barger Secures Unanimous Defense Verdict in 8-Day Jury Trial
Congratulations to Houston partners Peter Blomquist and Ashley Harshaw for securing a unanimous defense verdict in an 8-day jury trial in Harris County. In a case that had been pending for nearly four years, Plaintiff claimed significant injuries, including a traumatic brain injury, as a result of a multivehicle collision involving a tractor-trailer. The HB trial team argued the commercial driver was not a “substantial factor” in causing Plaintiff’s alleged injuries – a standard reinforced by the Texas Supreme Court’s recent Werner decision.
