The HB trial team argued the commercial driver was not a “substantial factor” in causing Plaintiff’s alleged injuries – a standard reinforced by the Texas Supreme Court’s recent Werner decision.

The plaintiff asserted that our client, a contractor who was not on-site at the time of the incident, was negligent in causing the injury.
