Kelly McKee Secures Victory in Auto Accident Property Damage Case
In a recent ruling from the Precinct 3 Justice of the Peace Court of Atascosa County, Texas, Senior Associate Kelly McKee successfully represented an insurance company in an auto accident property damage case that concluded with a directed verdict.
The case revolved around a lawsuit filed by a Plaintiff who alleged that her vehicle sustained significant damage due to the negligence of the insurance company's insured driver. The Plaintiff sought compensation, claiming the insurance company failed to provide an adequate settlement for the damages incurred.
After the trial commenced, a jury was empaneled, and the Plaintiff provided testimony regarding the circumstances of the accident. However, through a comprehensive and strategic cross-examination by Defense Counsel, critical inconsistencies were uncovered in her testimony.
Following the testimony, the Defense re-urged summary judgment as a directed verdict, arguing that the Plaintiff’s claims lacked a solid foundation due to insufficient evidence of causation and the absence of a valid contract.
